- 居住用財産とは、いわゆるマイホームのこと。買い替えなどの際に税法上の特例を受けられる対象となるもの。居住用財産として認められる家屋は、文字通り自らが住んでいる家屋のことである。特例を受けることを目的として入居したと認められた場合や、居住用家屋を新築するなどの際に仮住まいとして使用した家屋など、一時的な入居だと認められた場合、別荘などのような保養、趣味、娯楽のために所有した家屋などの場合は、居住用財産として扱われないと定められているため、特例を受けることもできない。居住用財産であることを証明するために、何かしら手続きをする必要はなく、実際に住居として使用するなどの実績があれば認められる。悪用しようとしなければ、マイホームを持っている人すべてが特例などを受けられることになる。
